1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Inquisitive Flow Learning ("Company", "we", "our", "us"), a company based in Quebec, Canada, governing your access to and use of our educational platforms including Mnemosyne and Aethon ("Service").
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
To use the Service, you must be at least 16 years of age (Canada-wide requirement). By using the Service, you represent and warrant that you meet this age requirement.
For Aethon (school platform):
- Students must be enrolled through an authorized institution
- Teachers and Administrators must be authorized by their institution
3. Account Registration
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Description of Service
Inquisitive Flow Learning provides AI-powered educational platforms:
- Mnemosyne: For individual learners - personalized AI tutoring, mind maps, spaced repetition
- Aethon: For schools - curriculum-aligned AI tutoring, teacher dashboards, progress tracking
The Service is designed for educational purposes only. While we strive for accuracy, AI-generated content should be verified independently for critical decisions.
5. Acceptable Use
You agree to use the Service only for lawful educational purposes. You must not:
- Use the Service to generate content that is illégal, harmful, threatening, abusive, or otherwise objectionable
- Attempt to bypass, disable, or circumvent any security features
- Use automated systems (bots, scrapers) to access the Service
- Share your account credentials with others
- Access accounts or data of other users without authorization
- Use the Service in ways that could harm or overburden our systems
6. Subscription and Payment
For Mnemosyne individual subscriptions:
- Billing: Subscriptions are billed in Canadian Dollars (CAD) through Stripe
- Recurring billing: Subscriptions automatically renew unless cancelled
- Cancellation: You may cancel at any time; access continues until the end of the billing period
- Taxes: Prices exclude applicable taxes (GST/QST)
For Aethon school subscriptions, billing terms are specified in institutional agreements.
7. Educational Content Disclaimer
The AI-generated educational content provided through the Service:
- Is intended for general educational purposes only
- Should not be relied upon as professional, legal, médical, or financial advice
- May contain errors or inaccuracies despite our efforts to ensure quality
- Should be verified with authoritative sources for important decisions
We do not guarantee specific learning outcomes or academic results.
8. Intellectual Property
Our Rights: The Service, including its design, features, code, and branding, is owned by Inquisitive Flow Learning and protected by intellectual property laws.
Your Content: You retain ownership of any content you create. By using the Service, you grant us a license to use your content solely to provide and improve the Service.
AI Outputs: Content generated by our AI may be used for your personal educational purposes.
9. Privacy
Use of the Service is governed by our Privacy Policy. We are committed to protecting your privacy in compliance with Quebec Law 25 and PIPEDA.
10. Service Availability
We strive to maintain reliable service, but we do not guarantee:
- Uninterrupted or error-free operation
- That the Service will meet all requirements
- That any errors will be corrected
We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
12. Termination
You may delete your account at any time. We may terminate or suspend your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting a notice on our website or sending an email. Your continued use of the Service after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of Quebec, Canada. Any disputes shall be resolved through the courts of Quebec.

1. Acceptation des Conditions
Ces Conditions d'Utilisation (« Conditions ») constituent un accord juridiquement contraignant entre vous et Inquisitive Flow Learning (« Société », « nous », « notre »), régissant votre accès et utilisation de nos plateformes éducatives incluant Mnemosyne et Aethon (« Service »).
En créant un compte ou en utilisant le Service, vous reconnaissez avoir lu, compris et accepté d'être lié par ces Conditions et notre Politique de Confidentialité.
2. Admissibilite
Pour utiliser le Service, vous devez avoir au moins 16 ans (exigence pancanadienne). En utilisant le Service, vous déclarez et garantissez que vous remplissez cette condition d'âge.
Pour Aethon (plateforme scolaire) :
- Élèves doivent être inscrits par un établissement autorise
- Enseignants et Administrateurs doivent être autorisés par leur établissement
3. Inscription au Compte
Vous êtes responsable de :
- Maintenir la confidentialité de vos identifiants de compte
- Toutes les activités qui se produisent sous votre compte
- Nous informer immédiatement de toute utilisation non autorisée
4. Description du Service
Inquisitive Flow Learning fournit des plateformes éducatives alimentées par l'IA :
- Mnemosyne : Pour les apprenants individuels - tutorat IA personnalisé, cartes mentales, répétition espacée
- Aethon : Pour les écoles - tutorat IA aligné sur le programme, tableaux de bord enseignants, suivi des progrès
5. Utilisation Acceptable
Vous acceptez d'utiliser le Service uniquement à des fins éducatives légales. Vous ne devez pas :
- Utiliser le Service pour générer du contenu illégal, nuisible, menaçant ou abusif
- Tenter de contourner ou désactiver les fonctionnalités de sécurité
- Utiliser des systèmes automatisés pour accéder au Service
- Partager vos identifiants de compte avec d'autres
6. Abonnement et Paiement
Pour les abonnements individuels Mnemosyne :
- Facturation : Les abonnements sont facturés en dollars canadiens (CAD) via Stripe
- Facturation récurrente : Les abonnements se renouvellent automatiquement sauf annulation
- Annulation : Vous pouvez annuler à tout moment
- Taxes : Les prix excluent les taxes applicables (TPS/TVQ)
7. Avertissement sur le Contenu Educatif
Le contenu éducatif généré par l'IA fourni par le Service :
- Est destiné uniquement à des fins éducatives générales
- Ne doit pas être considéré comme un conseil professionnel, juridique, médical ou financier
- Peut contenir des erreurs malgré nos efforts pour assurer la qualité
8. Propriété Intellectuelle
Nos Droits : Le Service, y compris sa conception, ses fonctionnalités, son code et son image de marque, appartient à Inquisitive Flow Learning
Votre Contenu : Vous conservez la propriété de tout contenu que vous créez.
9. Confidentialite
L'utilisation du Service est régie par notre Politique de Confidentialité. Nous nous engageons à protéger votre vie privée conformément à la Loi 25 du Québec et à la LPRPDE.
10. Limitation de Responsabilité
Dans toute la mesure permise par la loi :
- Le Service est fourni « tel quel » sans garantie d'aucune sorte
- Nous déclinons toutes les garanties implicites
- Nous ne sommes pas responsables des dommages indirects, accessoires ou consécutifs
11. Disponibilité du Service
Nous nous efforçons de maintenir un service fiable, mais nous ne garantissons pas :
- Un fonctionnement ininterrompu ou sans erreur
- Que le Service répondra à toutes les exigences
- Que toutes les erreurs seront corrigées
Nous pouvons temporairement suspendre le Service pour maintenance, mises à jour ou circonstances hors de notre contrôle.
12. Résiliation
Vous pouvez supprimer votre compte à tout moment. Nous pouvons résilier ou suspendre votre accès si vous violez ces Conditions. À la résiliation, votre droit d'utiliser le Service cesse immédiatement.
13. Modifications des Conditions
Nous pouvons mettre à jour ces Conditions de temps à autre. Nous vous informerons des changements importants en publiant un avis sur notre site Web ou en envoyant un courriel. Votre utilisation continue du Service après les modifications constitue une acceptation.
14. Loi Applicable
Ces Conditions sont régies par les lois du Québec, Canada. Tout litige sera résolu par les tribunaux du Québec.
